Day Holiday Confusion
Many
members have received confusing messages regarding substitute holidays
for when ANZAC Day falls on a weekend.
ANZAC Day in 2009
falls on Saturday 25th April which is a public holiday. For 2009
there is no substitute or additional days holiday applicable in
Victoria.
With a view to having a
consistent approach between States and, following a Council for the
Australian Federation (CAF) agreement to increase harmonisation of all
Australian states and territories’ approach to ANZAC Day,
Victorians will receive a substitute public holiday for ANZAC Day in
2010 and 2011.
The substitute days will be Monday 26 April in 2010 and Tuesday 26 April
in 2011 when ANZAC Day actually coincides with the Easter Monday public
holiday. However, in Victoria this year there is no substitute day
for ANZAC day.

Heat Reminder
In clarification of when high temperatures may result in work
ceasing the following applies:
Building sites where the site agreement specify a heat limit
and where a certified agreement specifies a heat range the terms
specified in the agreement apply.
Normal work. Other than the above specified site
agreements, the
inclement weather provisions in the award apply. Refer Clause 25.11. In
brief; where conditions of cold or extreme high temperature apply
to such an extent that it is not reasonable or, it is unsafe for
employees to continue working, the
employer has the right to transfer employees to another site. This should
be decided before any site meeting is held. Note: When transferring
employees under this provision the employer is to provide transport or a
travel allowance.
The decision is not made on a temperature it is an Occupational Health
and Safety decision where commonsense applies.
